🫙 How to Sell Wild Mushrooms Legally in the U.S.
Wild mushrooms are powerful ingredients, but also a sensitive product. If you’re a farm, market vendor, chef, or food co-op looking to sell foraged mushrooms legally, here’s what you need to know.

🌿 U.S. State-by-State Mushroom Regulations
Some U.S. states require permits or certifications to legally buy, sell, or forage wild mushrooms. Others have no regulations yet.
States with known regulations (subject to change):
- Oregon — mushroom certification required
- Minnesota — wild mushroom harvester certification
- Pennsylvania — approved species list + training
- Michigan — approved forager certification program
Important: If you’re selling mushrooms that were foraged in a regulated state, make sure the harvester has a valid permit. If the mushrooms are foraged from a legal state and sold in another, you are typically allowed to resell them — but you are liable for your side of the handling and sale.

- Each basket is tagged with a unique lot number and barcode with:
- Harvest team
- Region & date
- Species & weight
- Liability Insurance: We hold product liability insurance covering our operations until the mushrooms are picked up from the airport or from your location. Once it reaches you, you are liable as the final handler.
- No Warehouse, No FDA Registration Needed: Wild Fresh is considered small farm and exempt from FDA registration since we do not store or process product — we ship direct from forest to airport.
When necessary, we also use certified cold storage partners like Lineage Logistics and certified farms.
🔧 What You Should Know as a Seller or Buyer
- You are responsible for the safety of the mushrooms once you receive them
- Always inspect, sort, and clean before passing them on to clients
- Maintain your own product liability insurance
- Work only with reputable sources (like Wild Fresh) that provide proper documentation and tracking
